Divorce

- A joint Application for Divorce – where both spouses agree to sign; or
- A sole Application for Divorce – if one spouse refuses or fails to sign the Application for Divorce, the other spouse can apply without their signature. All sole applications must be served on the other spouse and the appropriate forms filed in the Court to prove the other spouse is aware of the Application for Divorce.
Joint Application:
- Professional fees: $1,650 including GST
- Plus Court filing fee (payable directly to the Court): $1,125 or $375 if both parties have a concession card
- Marriage certificate at cost (if required)
Sole Application:
- Professional fees:
- No Court appearance required: $2,200 including GST
- Court appearance required: $2,750 including GST
- Plus Court filing fee (payable directly to the Court): $1,125 or $375 if you have a concession card
- Bailiff fees at cost

Married couples may apply for a Divorce in the Federal Circuit and Family Court of Australia once they have been separated for more than 12 months.
Our office can assist with:
A Divorce Order changes your marital status from married to divorced. A Divorce Order does not change your name, impact your children’s rights to a relationship with you or your entitlement to a property settlement.
Once a Divorce Order comes into effect, a time limitation is triggered and a property settlement and/or spousal maintenance claim must be formalised, or a Court Application made, within 12 months of a Divorce Order coming into effect.
